TERMS AND CONDITIONS
The offer and sale of products on the website www.laltrapizza.it are regulated by the General Conditions of Sale set out below. The General Conditions of Sale are in accordance with the rules on off-premises contracts, specifically Leg. Decree 6 September 2005, n. 206 (Consumer Code).
The parties to the contract are:
- Mediterranea Quality Food Srl, , (hereinafter LALTRAPIZZA with offices in Via F. Turati n. 11 – 87028 Praia a Mare (CS), IT, Trade Register of the Cosenza Chamber of Commerce, Tax Code and VAT no. 03417090788
- Customer: the final customer, namely the natural person or business/professional acting not for entrepreneurial or professional reasons, identified via the website www.laltrapizza.it, who has concluded an order accepted by LALTRAPIZZA.
Application of and changes to the General Conditions of Sale
By making an order as required, the Customer acknowledges the information given during the purchase process and accepts the General Conditions of Sale in full. LALTRAPIZZA reserves the right to change the General Conditions of Sale, giving notice of such change on this web page. The applicable General Conditions of Sale are those in force at the time of the order. All changes become enforceable at the time of publication on the website.
Website registration
The Customer is required to register with a username and password. The Customer may ask for the goods to be delivered to a different address from that indicated at the time of registration.
To cancel registration from the website www.laltrapizza.it, please send an email to info@laltrapizza.it.
Characteristics and prices of products or services
The images of products may not perfectly represent their characteristics and may differ in terms of color, size, products and accessories. Any support information on the purchase process amounts to general information which cannot be referred to the actual characteristics of a single product.
Products are offered at the price indicated on the website at the date when an order is made.
Prices do not include VAT in force in the country of destination, which will be specified in the purchase invoice. Prices do not include delivery costs. In any event, such costs are indicated in the final section before sending an order and are specified in the order receipt confirmation sent to the Customer by email. Stores may apply local pricing policies.
Making an order
Products are shipped and delivered solely within the EU (excluding Outermost regions and Overseas countries and territories), the Republic of San Marino and Vatican City.
Orders are subject to minimum or maximum quantity limits and to product availability.
The promotional codes proposed by LALTRAPIZZA and its partners, if any, are valid for the product and period indicated together with the promotional code. Promotional codes cannot be refunded and cumulated. To enjoy the discounts and/or offers connected with promotional codes, the promotional code must be entered in the appropriate field when confirming an order on the website. If the promotional code is not entered during the order process, the order cannot be cancelled so as to enter the omitted code.
Orders by persons under 18 will not be accepted.
The steps required to make an order and conclude a purchase contract are clearly shown in the sequence of website pages through illustrative texts and images.
Any mistakes in the data entered can be corrected before sending an order.
Confirming order receipt and accepting orders
Upon receipt of an order, LALTRAPIZZA will automatically confirm its receipt to the Customer by email, summarizing the details of the order itself. Following receipt of each order, LALTRAPIZZA will check whether the product ordered is available; if it is, it will communicate order acceptance and product shipment.
Should LALTRAPIZZA not be able to fulfill an order, it will give prompt notice to the Customer.
Non-acceptance of an order does not entitle the Customer to claim any compensation or indemnity and does not give rise to any contractual or non-contractual liability for direct or indirect damages to people and/or things caused by such non-acceptance.
Product shipment
Products are shipped and delivered solely within the EU (excluding Outermost regions and Overseas countries and territories), the Republic of San Marino and Vatican City.
LALTRAPIZZA will send the products ordered by Customers, by courier, to the address indicated thereby, approximately within 72/96 hours from order acceptance. Such product delivery times are indicative.
Delivery costs are calculated automatically according to the place of delivery.
The recipient of the goods is required to pay all taxes and customs dues in accordance with the rules in force in the country of product destination.
The courier is responsible for delivery. LALTRAPIZZA will receive any notice of non-delivery or late delivery and help the Customer protect its rights in accordance with the law.
Product acceptance by the Customer
Should the packaging and/or product be damaged and should the number of batches or indications not correspond, the Customer shall immediately specify such fact in the delivery document. By signing the courier's document, the Customer certifies the external integrity of the product as well as conformity of delivery.
Any issues connected with the physical integrity, correspondence or completeness of the products received, shall be reported within 3 working days of delivery, by sending an email to info@laltrapizza.it.
Invoicing
An invoice will be issued for each order. Invoices will be based on the information provided by the Customer in each order. Once issued, invoices cannot be changed. When filling out an order, the Customer should specify whether the delivery address is different from the invoicing address.
Warranty
All products sold by LALTRAPIZZA, except for foodstuffs, are covered by the manufacturer's standard warranty and by a 12/24-month warranty against defects in accordance with Leg. Decree 24/2002 as amended and supplemented and articles 130 and 132 of Leg. Decree 206/2005. To enjoy customer support under warranty, the Customer must keep the corresponding invoice.
If the product bought has manufacturing defects and/or was damaged during transport, the Customer may ask for its replacement no later than 10 days of product receipt, by telegram or email to info@laltrapizza.it. The Customer is required to return the defective or damaged product in its original package, which must be intact in all its parts.
In case of product replacement, the delivery costs for product return shall be borne by LALTRAPIZZA. LALTRAPIZZA will then replace the product with an identical product or, if it is no longer in stock and subject to prior agreement with the Customer, with a product of equivalent value.
Governing law and competent venue
Products are sold and/or services are supplied in the territory of Italy and are governed by the laws in force in the Italian Republic. The competent venue for dispute settlement is the venue established by the Italian laws in force at the time of contract conclusion.
PAYMENTS
LALTRAPIZZA accepts the methods of payments listed below:
- payment in advance by bank transfer (bank charges to be paid in full by the purchaser);
- Stripe;
- PayPal: an online payment system that can be used by any company or consumer with an email address to make and accept payments, subject to prior registration. Payments are made via the PayPal platform.
SHIPPING AND DELIVERY
Product shipments and deliveries can be made exclusively within the European Union territories (excluding Ultra-peripheral Regions and Overseas Countries and territories), S. Marino, Vatican City.
LALTRAPIZZA will deliver products purchased exclusively to the destination specified in each order. We do not accept shipments to Mail Boxes.
LALTRAPIZZA will ship the products ordered by the Customer, by courier, to the address indicated by the same, approximately within 24 hours of acceptance of the order.
Italy
Delivery generally takes place within 2 working days. The times given for receiving the goods are indicative.
Shipping costs of €7,90 (VAT included) throughout Italy for orders under € 30,00 are invoiced on the basis of the rates indicated on the site on the date on which the order was transmitted.
Shipping is free for orders starting at € 30,00
Europe
Delivery generally takes 4-6 working days. The times given for receiving the goods are indicative.
Shipping costs are invoiced based on the rates indicated on the site on the date the order was sent, according to the following table.
EUR 20,00 VAT included
Austria, Belgium, Bulgaria, Czech Republic, France, Germany, Hungary, Luxembourg, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain.
EUR 23,00 VAT included
Denmark, Estonia, Finland, Greece, Ireland, Latvia, Lithuania, Sweden.
EUR 27,00 VAT included
Cyprus, Croatia, Malta.
The recipient of the goods is responsible for the payment of taxes and customs duties provided for by the legislation in force in the area of destination of the products.
The courier is responsible for delivery. LALTRAPIZZA undertakes to collect any reports of non-delivery or delayed delivery of the products and to assist the Customer in protecting his rights as per law.
RIGHT OF WITHDRAWAL
Pursuant to art. 59 letters c) the supply of goods made to measure or clearly personalized; d) the supply of goods which risk deteriorating or expiring rapidly; and e) the supply of sealed goods which are not suitable for return for hygienic reasons or related to the protection of health and have been unsealed after delivery.
Consumer Code, given the particular nature of the goods offered for sale, the provisions relating to the exercise of the customer's right of withdrawal do not apply.
The Products inside the package are carefully packed to avoid their damage.
Any damage to the packaging and / or the product or the mismatch in the number of packages or information must be immediately notified by placing a specific indication on the delivery document. By signing the courier's document, the Customer certifies the real external integrity of the product and the conformity of the delivery.
Any problems concerning the real physical integrity, correspondence or completeness of the products received must be reported within 3 working days of delivery by sending an email to info@laltrapizza.it.
The control of the package upon delivery is the responsibility of the customer. In the event that the package is damaged on the surface, we suggest accepting the package with reserve and, in the event that the products inside it are actually damaged, send us timely notice to the e-mail address info@laltrapizza.it or to the number WhatsApp 375 559 6636.
